Competition, Promotion and Giveaway Terms and Conditions

Effective Date: 17th July 2026

These Competition, Promotion and Giveaway Terms and Conditions (“Terms”) govern all competitions, promotions and giveaways (“Promotion”) conducted by Sparke Films Pty Ltd (ACN [650 148 977]), trading as Dinosaurs of the Wild West (“Sparke Films”, “Promoter”, “we”, “our” or “us”).
By entering a Promotion, you acknowledge that you have read, understood and agree to be bound by these Terms together with any campaign-specific rules published for that Promotion.
Where campaign-specific rules differ from these Terms, the campaign-specific rules will prevail to the extent of any inconsistency.

1. Definitions
In these Terms:
Campaign means the individual competition, giveaway or promotional campaign conducted by Sparke Films.
Eligible Entry means an entry that complies with these Terms and any campaign-specific rules.
Entrant means any person who enters a Promotion.
Prize means any item, experience, merchandise, digital product or other benefit offered as part of a Promotion.
Promotion means any competition, giveaway, contest, sweepstake or promotional campaign conducted by Sparke Films.

2. Eligibility
Unless otherwise specified in the relevant Campaign:
• Entry is open to individuals aged eighteen (18) years or older.
• Persons under the age of 18 may only participate with the consent of a parent or legal guardian where permitted by law.
• Entrants must comply with all applicable laws in their country, state or territory of residence.
• Employees, officers, directors, contractors and immediate family members of the Promoter and its related entities are not eligible to enter unless expressly permitted.
• The Promoter reserves the right to verify eligibility at any time.
• Residents of countries, states or territories where participation in the Promotion is prohibited or restricted by law are not eligible to enter.

3. Promotion Period
Each Promotion will commence and conclude on the dates and times published in the applicable Campaign materials.
Unless otherwise stated, all times are Queensland, Australia time.
Entries received outside the Promotion Period will not be accepted.
Promoter reserves the right to extend, shorten, suspend or cancel a Promotion where reasonably necessary.

4. How to Enter
The entry requirements for each Promotion will be described in the relevant Campaign materials.
Entry methods may include, without limitation:
• following official social media accounts;
• sharing or reposting Campaign content;
• tagging nominated accounts;
• using nominated hashtags;
• subscribing to newsletters;
• submitting photographs, videos or creative content;
• completing entry forms;
• making eligible purchases where permitted by law; or
• completing any other promotional requirements specified by Sparke Films.
Only Eligible Entries submitted during the Promotion Period will be considered.

5. Valid Entries
Unless otherwise specified:
• each Eligible Entry constitutes one (1) entry;
• multiple entries are permitted where expressly stated;
• automated, bulk, scripted or fraudulent entries are prohibited;
• incomplete or illegible entries may be declared invalid; and
• Promoter may reject any entry that it reasonably believes breaches these Terms.
Entrants are responsible for ensuring their contact details remain current.

6. Winner Selection
Where a Promotion is conducted as a game of chance, winners will be selected randomly from all Eligible Entries.
Where a Promotion is conducted as a game of skill, entries will be judged against the published judging criteria.
The method of winner selection for each Promotion will be described in the Campaign materials.
The decision of Promoter is final except where otherwise required by law.
No correspondence regarding the outcome will be entered into.

7. Prizes
Prize details will be published in the Campaign materials.
Unless otherwise specified:
• prizes are not transferable;
• prizes are not redeemable for cash;
• prizes cannot be exchanged;
• prize values are stated in Australian Dollars unless otherwise indicated;
• prizes must be accepted as awarded; and
• Promoter reserves the right to substitute a Prize with another prize of equal or greater value where reasonably necessary.
• Winners are responsible for any taxes, duties, customs charges or other government fees associated with claiming or receiving a Prize unless otherwise stated.
• If a Prize cannot lawfully or reasonably be delivered to a winner due to import restrictions, sanctions, local laws or other circumstances beyond Promoter’s control, Promoter reserves the right to substitute the Prize with one of equal or greater value or withdraw the Prize where no reasonable substitute is available.
Any images used in promotional material are for illustrative purposes only.

8. Winner Notification
Winners will be notified using the contact details provided during entry or via the platform through which the entry was submitted.
Unless otherwise stated, winners must respond within five (5) business days.
Where a winner:
• cannot be contacted;
• fails to respond;
• is found to be ineligible;
• provides incorrect contact details; or
• declines the Prize,
The Promoter may select an alternative winner where permitted by law.

9. Prize Delivery
Prizes will be delivered using the method determined by the Promoter.
Where physical prizes are supplied:
• winners are responsible for providing accurate delivery information;
• Promoter is not responsible for delays caused by postal or courier providers;
• additional customs duties, taxes or import charges are the responsibility of the recipient unless otherwise stated.
Digital prizes will be delivered electronically where applicable.

10. Verification
Before awarding a Prize, Sparke Films may require reasonable proof of:
• identity;
• age;
• eligibility;
• ownership of the winning entry; and
• compliance with these Terms.
Failure to provide requested information within the specified timeframe may result in disqualification.

11. Unclaimed Prizes
Where permitted by law, if a Prize remains unclaimed after the specified claim period, Promoter may:
• award the Prize to another eligible entrant;
• conduct a redraw or re-judge the Promotion; or
• otherwise deal with the Prize in accordance with applicable law.
The applicable process for unclaimed prizes may also be described in the Campaign materials.

12. Publicity
By entering a Promotion, you agree that, if you are a winner, Promoter may use your name, social media username, likeness, submitted content, photographs, videos and entry for promotional, advertising and marketing purposes in any media worldwide, without additional compensation, unless prohibited by law.
Where required by law, Promoter will obtain any additional consent before using your personal information for publicity purposes.

13. Intellectual Property
Entrants retain ownership of any original photographs, videos, artwork, written submissions or other creative works submitted as part of a Promotion.
By entering a Promotion, you grant Promoter a non-exclusive, worldwide, royalty-free, perpetual licence to reproduce, publish, display, adapt and communicate your submitted content for the purposes of:
• administering the Promotion;
• announcing winners;
• promoting the Promotion;
• marketing Dinosaurs of the Wild West;
• marketing Promoter and its productions; and
• promoting associated films, television projects, merchandise and future promotional campaigns.
You warrant that any material submitted:
• is your original work or that you have obtained all necessary permissions;
• does not infringe the intellectual property rights of any other person; and
• does not contain unlawful, defamatory, offensive or misleading content.

14. Privacy
Any personal information collected in connection with a Promotion will be handled in accordance with the Promoter’s Privacy Policy.
By entering a Promotion, you consent to Promoter collecting, storing and using your personal information for the purposes of:
• administering the Promotion;
• verifying eligibility;
• contacting winners;
• delivering prizes;
• complying with legal obligations; and
• conducting related promotional activities.
Personal information will not be sold to third parties.
While reasonable security measures are implemented, no electronic transmission or storage system can be guaranteed to be completely secure.

15. Australian Consumer Law
Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded under the Australian Consumer Law or any other applicable legislation.
Where liability cannot lawfully be excluded, it is limited to the maximum extent permitted by law.

16. Limitation of Liability
To the maximum extent permitted by law, Promoter, its related entities, directors, officers, employees, contractors, agents and representatives are not liable for any loss, damage, cost, expense or injury arising from or in connection with:
• participation in a Promotion;
• technical failures;
• lost, delayed or corrupted entries;
• errors in prize administration;
• acceptance, possession or use of a Prize;
• cancellation or modification of a Promotion; or
• circumstances beyond the reasonable control of Promoter.
Nothing in this clause limits any rights that cannot lawfully be excluded.

17. Fraud and Disqualification
Promoter reserves the right to disqualify any entrant who:
• breaches these Terms;
• tampers with the entry process;
• submits false or misleading information;
• uses automated entry methods;
• engages in fraudulent, deceptive or unlawful conduct; or
• acts in a manner that may damage the reputation or integrity of the Promotion.
Where a Prize has already been awarded, Promoter reserves the right to require its return where legally permitted.

18. Modification, Suspension and Cancellation
To the extent permitted by law, Promoter reserves the right to modify, suspend or cancel any Promotion where reasonably necessary due to:
• fraud;
• technical failures;
• legal or regulatory requirements;
• force majeure events; or
• circumstances beyond its reasonable control.
Where practicable, any changes will be published through the same channels used to promote the Promotion.

19. Trade Promotion Permits
Where required under applicable law, including the laws of any Australian State or Territory, Promoter will obtain any necessary permits or approvals before conducting a Promotion. Any permit numbers required by law will be published in the relevant Campaign materials.

20. Social Media Platforms
Where a Promotion is conducted through Instagram, Facebook, TikTok, X (formerly Twitter), YouTube, Kickstarter or any other social media or online platform:
• the Promotion is in no way sponsored, endorsed, administered by or associated with that platform;
• entrants release that platform from any responsibility or liability relating to the Promotion; and
• entrants agree to comply with the applicable platform’s terms of use.

21. Governing Law
These Terms are governed by the laws of Queensland, Australia.
Entrants submit to the non-exclusive jurisdiction of the courts of Queensland and any courts competent to hear appeals from those courts.
